LEGAL INFORMATION & GUARANTEE RAHUL TRAVEL GROUP (RTG)
Version: 1.0
Date: 1 January 2024
PART A. STANDARD INFORMATION FORM FOR PACKAGE TRAVEL
Mandatory information pursuant to Directive (EU) 2015/2302 and Articles 7:500 et seq. of the Dutch Civil Code.
Article 1. Essential Rights of the Traveller
The combination of travel services offered to you constitutes a package travel arrangement within the meaning of Directive (EU) 2015/2302.
As a result, you are entitled to all EU rights applicable to package travel. Rahul Travel Group (RTG) is fully responsible for the proper performance of the entire package travel arrangement.
RTG also provides the legally required protection to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that RTG becomes insolvent (see Part B).
Article 2. Your Rights Summary
Under the Directive, you are entitled to the following rights:
1. Information: Travellers receive all essential information about the package travel arrangement before entering into the agreement.
2. Liability: RTG is liable for the proper performance of all travel services included in the agreement.
3. Emergency Contact: Travellers receive an emergency telephone number or contact details through which they can reach the organiser or the travel agent.
4. Transfer: Travellers may transfer the package travel arrangement to another person within a reasonable period and subject to any resulting additional costs.
5. Price Revision: The price of the package may be increased only if specific cost factors rise (e.g., fuel prices) and only if expressly provided for in the agreement, and never later than 20 days before the start of the package travel.
6. Cancellation: Travellers may terminate the agreement without paying cancellation fees and receive a full refund if a fundamental element of the package travel (other than the price) is significantly altered.
7. Force Majeure & Extraordinary Circumstances: Travellers may terminate the agreement before the start of the package travel without paying cancellation fees in case of extraordinary circumstances (e.g., serious security risks at the destination).
8. Insolvency: If RTG becomes insolvent after the start of the package travel and transport is included, repatriation of travellers is guaranteed.
PART B. GUARANTEE SCHEME (STO GARANT)
Mandatory pursuant to Article 7:512 of the Dutch Civil Code.
Article 3. STO Garant
To comply with the statutory guarantee obligation, Rahul Travel Group makes use of the STO Garant guarantee scheme.
You may verify this via the participant page on www.sto-garant.nl.
All information regarding STO Garant can be found on www.sto-garant.nl.
Article 4. Third-Party Funds Arrangement (Certo Escrow)
Under this guarantee scheme, you do not pay the travel sum to RTG, but to the third-party funds account of Stichting Derdengelden Certo Escrow — a payment service provider registered with the Dutch Central Bank (DNB) and the Netherlands Authority for the Financial Markets (AFM).
1. Payment: After booking, you will receive an email from Certo Escrow with payment instructions.
2. Release of Funds: Certo Escrow releases the travel sum to RTG only after the trip has been completed in good order (one day after the end date).
3. Insolvency: If RTG becomes insolvent (bankruptcy or suspension of payments) before the end of the trip, the travel sum will not be released to RTG.
In such cases, Stichting Derdengelden Certo Escrow ensures that you receive a refund or, if you are already travelling, that your trip can continue or that you can be repatriated.
Article 5. Procedure in Case of Emergency or Insolvency
If RTG is unable to fulfil its obligations due to financial insolvency, the execution of the guarantee is handled by STO Garant.
• You must contact STO Garant immediately via www.sto-garant.nl.
• Because your funds are securely held in the third-party account, you incur no financial risk.
